คำพิพากษาศาลฎีกาที่ 4953/2563
จำเลยประกอบอาชีพทนายความ และเป็นลูกจ้างของโจทก์ โจทก์มอบอำนาจให้จำเลยเป็นผู้ดำเนินคดีแทนโจทก์ จำเลยมีอำนาจรับเงินและออกใบเสร็จรับเงินแทนโจทก์ได้ การที่ ส. ชำระเงินค่าเสียหายให้แก่โจทก์โดยโอนเงินเข้าบัญชีของจำเลย จำเลยในฐานะตัวแทนผู้รับเงินของโจทก์มาครอบครองไว้จึงมีหน้าที่ต้องส่งมอบเงินนั้นคืนให้แก่โจทก์ ส. โอนเงินค่าเสียหายเข้าบัญชีจำเลย 11 ครั้ง แต่จำเลยไม่ได้คืนเงินที่ ส. โอนมาแต่ละครั้งให้แก่โจทก์ทันที โดยนำมาคืนโจทก์ทีเดียว 500,000 บาท ซึ่งเป็นเวลาภายหลังที่ ส. โอนเงินครั้งแรก 5 เดือนเศษ และภายหลังโอนเงินครั้งสุดท้าย 1 เดือนเศษ จำเลยปิดบังไม่แจ้งเรื่องที่ ส. โอนเงินค่าเสียหายที่ชำระให้แก่โจทก์เข้ามาในบัญชีของจำเลย การที่จำเลยเอาเงินที่ ส. ชำระค่าเสียหายให้แก่โจทก์โดยโอนเข้าบัญชีของจำเลย 11 ครั้ง ไปใช้จ่ายเพื่อประโยชน์ของจำเลยโดยโจทก์ไม่ทราบและยินยอมให้ทำได้นั้น เป็นการเบียดบังเอาทรัพย์ของโจทก์เป็นของตนโดยทุจริตอันเป็นความผิดฐานยักยอก แม้จำเลยนำเงิน 500,000 บาท มาคืนโจทก์ก็ไม่ลบล้างการกระทำของจำเลยที่เป็นความผิดสำเร็จแล้วได้ การที่จำเลยซึ่งมีอาชีพเป็นทนายความอันย่อมเป็นที่ไว้วางใจของประชาชนยักยอกเงินของโจทก์ไปในระหว่างเวลาที่โจทก์มอบอำนาจให้จำเลยเป็นผู้ดำเนินคดีแทนโจทก์โดยให้มีอำนาจรับเงินและออกใบเสร็จรับเงินแทนโจทก์ได้ การกระทำของจำเลยจึงเป็นความผิดตาม ป.อ. มาตรา 354 (เดิม) ประกอบมาตรา 352 วรรคหนึ่ง
