เชื่อว่ารู้มานานแล้วแต่ไม่ได้แจ้งความ คดีขาดอายุความ

        โจทก์ทราบว่าจำเลยทั้งห้าร้องทุกข์ว่าทุจริตต่อหน้าที่ตั้งแต่วันที่ 25 กุมภาพันธ์ 2557 ประกอบกับได้ความจากคณะกรรมการสืบสวนหาข้อเท็จจริงว่าเคยเรียกโจทก์และจำเลยทั้งห้ามาไกล่เกลี่ยในปี 2557 เนื่องจากเห็นว่าโจทก์และจำเลยทั้งห้าเป็นเพื่อนร่วมงานกัน จึงเชื่อว่าโจทก์ทราบมูลความผิดและรู้ตัวผู้กระทำความผิดเมื่้อวันที่ 25 กุมภาพันธ์ 2557  แต่โจทก์มิได้ร้องทุกข์ภายในสามเดือนนับแต่วันที่รู้เรื่องความผิดและรู้ตัวผู้กระทำความผิด โดยโจทก์นำคดีมาฟ้องวันที่ 15 กันยายน 2559 ซึ่งเป็นเวลาหลังจากมีการร้องเรียนแล้วกว่า 2 ปี  คดีโจท์จึงขาดอายุความ

คำพิพากษาศาลฎีกาที่ 3870/2562
โจทก์ทราบว่า จำเลยทั้งห้าร้องเรียนโจทก์ว่าทุจริตต่อหน้าที่ตั้งแต่วันที่ 25 กุมภาพันธ์ 2557 ประกอบกับได้ความจากคณะกรรมการสืบสวนหาข้อเท็จจริงว่า เคยเรียกโจทก์และจำเลยทั้งห้ามาพูดคุยไกล่เกลี่ยในปี 2557 เนื่องจากเห็นว่าโจทก์และจำเลยทั้งห้าเป็นเพื่อนร่วมงานกัน จึงเชื่อว่าโจทก์ทราบมูลความผิดและรู้ตัวผู้กระทำความผิดว่าเป็นจำเลยทั้งห้าตั้งแต่วันที่มีการร้องเรียนในวันที่ 25 กุมภาพันธ์ 2557 เมื่อความผิดที่โจทก์ฟ้องขอให้ลงโทษจำเลยทั้งห้าตาม ป.อ. มาตรา 326 และ 328 เป็นความผิดอันยอมความได้ แต่โจทก์มิได้ร้องทุกข์ภายในสามเดือนนับแต่วันที่รู้เรื่องความผิดและรู้ตัวผู้กระทำความผิด โดยโจทก์นำคดีนี้มาฟ้องเมื่อวันที่ 15 กันยายน 2559 ซึ่งเป็นเวลาหลังจากมีการร้องเรียนแล้วกว่า 2 ปี คดีโจทก์จึงขาดอายุความตาม ป.อ. มาตรา 96
