คำพิพากษาฎีกาที่  3553/2568
    สหกรณ์จำเลยที่ 3 ผู้รับจำนองปฏิเสธไม่ยอมรับจำนวนเงินที่โจทก์ซึ่งเป็นผู้ซื้อทรัพย์สินซึ่งจำนองจากการขายทอดตลาดเสนอจะใช้เท่ากับราคาประเมินของเจ้าพนักงานบังคับคดีโดยอ้างว่า ไม่เป็นจำนวนอันสมควรกับราคาทรัพย์สิน จำเลยที่ 3 ต้องฟ้องคดีต่อศาลภายใน 1 เดือน นับแต่วันมีคำเสนอเพื่อให้ศาลพิพากษาสั่งขายทอดตลาดทรัพย์สินซึ่งจำนองนั้น ตามประมวลกฎหมายแพ่งและพาณิชย์ เมื่อจำเลยที่ 3 ได้สนองรับคำเสนอของโจทก์โดยปริยายภายหลังจากที่มีหนังสือปฏิเสธมาก่อนหน้านี้ตามมาตรา 741 จำเลยที่ 3 ต้องยอมรับเงินที่โจทก์นำมาวางสำนักงานวางทรัพย์และจดทะเบียนไถ่ถอนจำนองให้โจทก์
